The Opioid Crisis

You’ve read the headlines about the escalating opioid crisis, which is worsening due to social isolation. The opioid crisis that pervades America stems back to two decades ago.

  • What are the civil, criminal, and administrative ramifications of the opioid crisis?
  • What are the damages from drug use?
  • How did pharmaceutical marketing techniques created not only addiction to prescription medication, but also to using heroin leading to death, disability and tragedy.

How can LNCs assist with these kinds of cases?

Joe Flores - 2

Joe Flores Esq NP RN

Joe Flores Esq NP RN is both a nurse practitioner and an attorney in Texas. He has practiced in several areas of the law, including personal injury, traumatic brain injury cases, whistleblower law, and the defense in cases where nursing and the law overlap.

While Joe earned his BSN, he started reviewing medical records for attorneys. His expert witness work helped fund his nurse practitioner program and law school. Joe feared attorneys when he was a nurse and did not think of becoming one.

His first case as a legal nurse consultant changed his perspective when he found the nursing home lied about how much a resident ate and starved them on purpose. Joe serves in a dual role now: trial attorney and nurse practitioner.

“Let’s give you something for pain” - Opioid Overdoses in the Hospital

A little of this, a little of that – nurses in hospitals have choices of what to give patients for pain and sedation: IV push, PCA pumps, pills, or patches. Tragedy strikes when nurses do not pay attention to the amount and frequency of administration or the drug interactions. Opioid overdoses can’t always be reversed by Narcan.

The attorney asks you for help in deciphering the sequence of events that led up to the patient’s death. What the factors that lead to an overdose, and how can you help the attorney?

Virtual Trials: A New Virtual World

Courthouses are mostly closed. Attorneys are exploring new ways to try cases.

  • Should they present their case virtually or wait for courthouses to open?
  • How do virtual trials affect defendants, plaintiffs, the jury, judge and attorneys?

  • What does the LNC need to know about virtual depositions and trials?

We invited Peter Akmajian Esq. from Arizona to share his perspective on this change. Peter Akmajian is a trial lawyer with 30+ years of experience under his belt. His trials have mainly involved serious personal injury, medical malpractice and wrongful death.  He was a civil defense lawyer for many years before making the switch to the plaintiff's side recently.
